State Laws

Why does states such as NC have open carry laws, but if someone calls the police because they see you with a gun you could be charged with going armed to the terror of the public?

The law says you can open carry, but you can be charged with a crime?

This makes no sense....

Can someone elaborate?

So yes, you can open carry and be charged for a crime in the same way as someone with a carry permit can still commit murder with a legally concealed weapon.

So why have open carry then? I have seen so many videos where people walked into a Walmart which had no signs posted...and the people were just shopping with a pistol on their side not terrorizing customers...and here comes tons of police escorting them out...sometimes in handcuffs asking what the hell are they doing? Most people tried to explain that it was perfectly legal, but the cops say no!

I just think it's crazy to have an open carry law and be arrested for it at the same time. I'm a ccw holder myself and my cop friends tell me to keep it concealed. They stated they have been instructed to respond to the calls unless you were a sworn officer. I said well that's a dumb open carry law then...most cops agreed.

Nothing "dumb" about the law.

Now how it's enforced; that's another story....

A couple of law suits against the offending agency, and that would change.
